controller of the processing of personal data provided by the data subjects
through the websites www.montagud.com and www.libreriagastronomica.com (hereinafter, the "Websites") is Mencía Gastronomía,
S.L., with registered office at Paseo de la Castellana, nº 40 – Piso 8, 28046,
Madrid, Tax Identification Number (N.I.F.) B-65644478 and email address administracion@montagud.com.
2. Purposes and legal bases of processing
Montagud processes the personal data provided by the data subjects for the following purposes:
• Manage relationships and purchases with customers and potential customers, as well as with any data subject who contacts Montagud. The basis that legitimises this processing is the existence of a contractual or pre-contractual relationship.
• To send data subjects commercial communications about Montagud’s products, services, offers, promotions, events or news. The basis that legitimises this processing is the consent of the data subject, given when the data subject requests to receive such communications or, where there is a prior contractual relationship, we may send to the data subject such communications on the basis of our legitimate interest.
• To manage the registration of the user through the Websites and the registration of data subjects to the events organised or sponsored by Montagud, in order to allow their participation, confirm their attendance, send them relevant information about the event or ask for their opinion or subsequent assessment. The basis that legitimises this processing is the existence of a contractual or pre-contractual relationship with the data subject, or the consent of the data subject when necessary.
• To manage queries or questions made by customers, potential customers and visitors to the Websites, through the different contact forms with Montagud. The basis that legitimises this processing is the existence of a contractual or pre-contractual relationship, or the consent given by the data subject when contacting us.
3. Recipients and international data transfers
Unless otherwise indicated, Montagud will not transfer the personal data of the interested parties to third parties, unless there is a legal obligation or an express authorisation of the data subject. In any case, if it is necessary to transfer data to third parties, the data subjects will be informed in advance and their consent will be requested when necessary.
Notwithstanding the foregoing, Montagud has service providers who act as data processors and help us to carry out our work. Montagud, in compliance with data protection regulations, has signed contracts with its data processors that regulate the personal data processing.
In addition, if it is necessary to carry out any international transfer of data to countries that do not belong to the European Economic Area ("EEA") and that do not offer an adequate level of data protection, the appropriate safeguards provided for in the data protection regulations would be applied, such as the verification of the existence of an adequacy decision by the European Commission or the signing of the corresponding standard contractual clauses approved by the European Commission.
Finally, it is possible that, on certain occasions, we may have to communicate your data to third parties, including Courts and Tribunals, State Security Forces and Bodies or Prosecutor's Office, consulting and legal advisory firms.
4. Retention periods
Montagud will keep your personal data for the time necessary to fulfil the purpose for which they were collected. Once the corresponding purposes have been fulfilled, Montagud will keep the personal data duly blocked to the extent that Montagud may be responsible or when required by applicable regulations.
5. Users' rights
We inform you that the data subjects have the right to exercise at all times, under the terms established by current legislation, their rights of access, rectification or erasure of data, request the restriction of the processing, object it, request the portability of their data, as well as revoke the consent given. You can exercise any of these rights free of charge, as well as withdraw your consent at any time, by sending a post to Paseo de la Castellana, nº 40 – Piso 8, 28046, Madrid, or by email to administracion@montagud.com, including the reference "Data Protection" and, where it is necessary to verify your identity, accompanying a copy of your National Identity Document (DNI) or equivalent document.
In any case, you may at any time lodge a complaint before the Spanish Data Protection Authority in www.aepd.es.
